CDC 2019 statistics show that the Illinois divorce rate is 1.3 per 1000 residents, making it one of the states with the lowest number of divorces in the USA.

In the past, Illinois accepted both fault and no-fault grounds for divorce. However, according to amendments made to the state Family Law in 2016, it is now a purely no-fault state. It means that spouses can’t state infidelity, bigamy, cruelty, or any other type of marital misconduct as the reason to end their marriage.

The only ground for divorce is an irretrievable breakdown of the marriage caused by irreconcilable differences between spouses. However, a couple needs to prove that the attempts to save the marriage have failed or that future reconciliation is not in the spouses’ best interests.

Additionally, if spouses have lived separately for at least 6 months before the divorce decision, the “irreconcilable difference” requirement can be considered fulfilled.
